February 5, 2010

WASHINGTON FUGITIVE NEWS -- Gabriel Indelicio Nevarez, is most wanted for the first-degree murder by the Tacoma Police in the drive-by shooting of Kyle "Buddy" Grinnell Jr in Tacoma, Washington. The 21-year-old Grinnell was pressure washing the sidewalk outside of his apartment when he was stuck by a bullet. That bullet was shot by Nevarez who intended to kill a rival drug dealer standing nearby, Juan Carlos Ruiz. So, Grinnell was fatally shot during a spray of gunfire because he was within target range.

Additionally, charged for Grinnell's murder is 32-year-old Windy Michelle Ware, who has pled not guilty as charged. According to an affidavit of probable cause filed by the Pierce County Prosecutor's Office, Ware showed Nevarez where to find Juan Carlos Ruiz, and claimed Nevarez has been a "major supplier" of methamphetamine in the Tacoma area for some time. Allegedly, Ware knew of the feud between the two men, and thought she could cull favor with Nevarez by showing him his enemy's whereabouts. Ware met Nevarez at a restaurant parking lot where she told Nevarez to "follow me" to find Ruiz.

After the shooting, Ruiz told detectives that he was standing on the front steps of a house when he saw a gray Cadillac rolling down the street. Meanwhile, another witness who saw the shooting wrote down the license plate of the Cadillac that was later discovered to belong to a relative who lived with Nevarez. When the car drew alongside the apartment house, the driver, identified as Nevarez, pointed a gun and fired multiple rounds mortally wounding Grinnell who was working nearby. Grinnell slowly died of those wounds inflicted by Nevarez.

Likewise, this is not Gabriel Indelicio Nevarez first shooting. In 2004, while a teen attending Mount Tahoma High School in Tacoma, Nevarez during school hours deliberately went to another school, Lincoln High School, and shot at several students in the school courtyard. Nevarez gunfire wounded a girl in the leg. Luckily, the girl recovered, so Nevarez was charged as an adult with two counts of first-degree assault and one count of second-degree unlawful possession of a firearm.

However, the case never went to trial because in June 2005, Judge James Orlando ordered Nevarez sent to Western State Hospital for a mental examination. Psychologists at Western State Hospital concluded that Nevarez was mentally unfit to stand trial. They cited a number of factors including "intellectual, cognitive and other psychological limitations," according to their report submitted to court. Further writing, "due to the symptoms of Mr. Nevarez's mental disorders, it is our opinion that he lacks the capacity to understand the complexity and nature of the proceedings against him and work with his attorney in his own defense." Adding Nevarez, "is currently a well-above-average risk for future danger to others or for committing future criminal acts jeopardizing public safety and security." Therefore, they advised that the charges against Nevarez be dismissed and that he be evaluated for a possible involuntary civil commitment to a psychiatric hospital. Acting on that advice in March 2006, Judge Lisa Worswick signed an order dismissing the charges against Nevarez and ordering sheriff's deputies to "transport the defendant to Western State Hospital for the purpose of petitioning for said defendant's involuntary commitment." By this time, Nevarez, was 18, and spent six months in a community-based program before his release in December 2006.

So, two months after being released from a community-based treatment program, Nevarez allegedly killed 21-year-old Kyle Grinnell in the drive-by shooting. Sadly, this killing shows that some psychopaths can at will, fool the best psychologists into a false diagnosis. That diagnosis is the patient has reached an average acceptable risk as NOT to present a future danger to others.

Killer is described as:

  • Birth Date: May 16, 1988
  • Height: 69 inches
  • Weight: 180 pounds
  • Eyes: Black
  • Hair: Black
  • Sex: Male
  • Race: Hispanic
